AI Enhanced Online Family Courts in India and Access to Justice: Opportunities and Risks

Abstract

The COVID-19 pandemic has accelerated a global shift from traditional in-person family court proceedings toward online or hybrid models, supported by internet technology and, increasingly, Artificial Intelligence (AI). The integration of AI into Online Dispute Resolution (ODR) presents a transformative opportunity for resolving family disputes in India, where traditional litigation remains slow, expensive, and highly cumbersome. As of 2024, approximately 1.2 million family court cases are pending across India, and the Indian judiciary faces a massive backlog particularly in matters concerning women's rights, child custody, maintenance, and domestic violence. The integration of AI-powered tools such as case triage, e-filing, sentiment analysis, and online dispute resolution is showing early signs of improving access to the legal system. This shift promises enhanced access to justice through greater convenience, reduced costs, and broader participation, particularly for vulnerable litigants. However, it also poses several significant risks, including the digital divide, challenges to procedural fairness, privacy concerns, and the potential misuse of AI-generated evidence. This article explores how digital technologies and Artificial Intelligence (AI) are transforming India's family law system. This research paper adopts a comparative approach, examining the changes implemented across various jurisdictions, including the United Kingdom, the United States, India, and Australia. Paper analyses both the opportunities and the risks involved, and offers recommendations for balanced implementation
