Abstract

Defamation relates with the tarnishing of the reputation of an individual in the society. The nature of defamation in India is both way, civil as well as criminal. Both types of defamation exist in the society as a defence against the falsity of statements made by the wrongdoers. The law of defamation is supposed to protect people’s reputation from unfair attack. The present paper analyse the nature and scope of defamation law in civil as well as  form,   the available  remedies against the claim of defamation against the wrongdoer and also whether the defamation law is in contradiction with the fundamental right would be in contradict with our fundamental right to freedom of speech and expression under Article 19. available legal remedies to safeguard the rights and reputation of Individuals in society through landmark judgement in defamation cases.
