Abstract

A very nice line written by Shakespeare, “a good name is worth more than good riches”. But through defamation a person injures others person's character, fame, or reputation by false and malicious statements. As it is well known that the India is a democratic country, wherein freedom of speech and expression is considered as a fundamental right which is not absolute but subject to certain reasonable restrictions and the defamation being one of them. However, defamation is known as calumny, vilification, libel, slander or traducement is the oral or written communication of a false statement about another that unjustly harms their reputation and it usually depends on its nature which constitutes whether it is a tort or crime.
