Tracing the Doctrines of Res Sub judice and Res Judicata: A Comprehensive Review

The doctrines of res sub judice and res judicata are pivotal principles in civil procedure law, aimed at preventing multiplicity of litigation and ensuring judicial efficiency. The principle of res sub judice, as outlined in Section 10 of the Civil Procedure Code (CPC), prohibits the adjudication of a lawsuit that is already under consideration in another appropriate court. This principle ensures that courts do not concurrently adjudicate the same issue between the same parties, thereby avoiding contradictory verdicts and judicial redundancy. It upholds judicial economy by suspending the trial of a case until the previously instituted suit is resolved.
