Abstract

Marital rape remains a pervasive yet under acknowledged form of gender-based violence in India. This paper sheds light on the multifaceted dimensions of marital rape within the Indian context, examining its prevalence, impact, and systemic challenges in addressing it. Despite legal advancements, including recent amendments to India laws, the reality on the ground reflects a stark disconnection between legal frameworks and the lived experiences of survivors. Drawing on existing research and anecdotal evidence, this paper explores the societal, cultural, and structural factors that perpetuate marital rape and contribute to its
underreporting. It also examines the profound physical, emotional, and societal consequences experienced by survivors, highlighting the intersections of gender, caste, class, and religion in shaping vulnerability. Furthermore, the paper delves into the complexities of navigating the legal system and accessing support services for survivors. By amplifying survivor voices and
advocating for survivor-centered approaches, this paper underscores the urgent need for comprehensive legal reforms, grassroots interventions, and societal shifts to effectively address and prevent marital rape in India. Ultimately, it calls for collective action and solidarity in creating a society where every individual right to bodily autonomy and dignity is respected and upheld.
