Forensic psychology: Gray area to be enlightened in Criminal Justice System of Nepal

A field of psychology that deals with all aspects of human behavior as it relates to the law or legal system is forensic psychology. Forensic psychology has played a large role in the criminal justice field over the years. Forensic psychology is a unique, yet crucial blend of both psychology and the criminal justice system. Though application of forensic psychology can make justice system more reliable, effective and efficient, intervention of forensic psychology in Criminal Justice System of Nepal has yet not been acknowledged. There is immense scope in juvenile justice, criminal justice and victim justice system. If proper implication of forensic psychology could be done in investigation, adjudication, prosecution and implementation of decision then criminal justice system can be justice oriented and parties related to criminal justice system could realize justice.

7. All scientists, whether they are physicists, chemists, biologists, sociologists, or psychologists, use empirica l methods to study the topics that interest them. Empirical methods include the processes of collecting and organizing data and drawing conclusions about those data. The empirical methods used by scientists have developed over many years and provide a basis for collecting, analyzing, and interpreting data within a common framework in which information can be shared. 30. In Tirtha Dangol vs. HMG, NKP 2042(1985) D.No. 2355, Tirtha Dangol was charged with homicide of his wife. He plead that he was suffering from men tal illness and during investigation hospital reported that he was suffering from Schizophrenia. No prior Medical history of defendant was provided before the court and he was set acquitted merely on the basis of document of hospital. In Gauri Pun vs. HMG, NKP 2045(1988), D.No. 3407, Gauri was charged with homicide of her mother in law. In this case also her health examination report received from hospital showed that she was suffering from Schizophrenia. Howeve Supreme Court held her punishiable and stated that Section 1 of Chapter in punishment cannot be attracted for crime committed in teh condition of mental sanity. In HMG vs. Kuldhwoj Lama, NKP 2046(1989), D.no. 3848, Kuldhoj was charged of killing his wife. His health examination reports show that his mental state was satisfactory; however, his thinking power was decreasing. The repot of the mental hospital showed that he was suffering from Schizophrenia. The defendant in his statement stated that he did not know what he did and he came to kn ow the consequence of incident after treatment. Hence, he was acquitted from charge. In Khomnath Dahal vs. NG, NKP 2071(2015),D.no. 9158 , In this case defendant killed wife of his brother after quarrel between his wife and the deceased. Defendant confessed at police and also at court. He was convicted of homicide. He appeals at Appeal court stating that he was suffering from mental illness Schizophrenia. But neither Appeal court nor Supreme Court convicted him, and court held that to take plea of insanity s/he need to be in state of insanity when s/he committed the offence.
31. In Dan Bikram Thapa vs. NG, NKP 2073(2016), P.1673, In this case defendant kill his own father. He submitted that he was suffering from Schizophrenia and he was under medication. His medical history also shows that he was suffering from mental disease but his appeal for insanity defense was not granted. He wa s held gulity of homicide and court held that to get defense of insantiy one should be in situation that s/he could not be able know the consequence of the act s/he did at the time.
