Criminal Intimidation and Failed Prosecutions

Abstract

Criminal Intimidation occurs in every high-profile case in India. Being cognizant of the same the parliament, the law commissions and the judiciary are still not taaking adequate steps curb such practises and prevent witness harassment.  Therefore, this article focuses on aspects of criminal intimidation of witnesses and victims, and how it hampers the judicial decision, it will discuss the factors affecting witnesses who fall prey to intimidation. Further the laws governing witness intimidation and protection will be critically evaluated, and finally it will conclude by reviewing the suggestions provided by the law making bodies/commission in the interest of bettering the witness evidence during the trial leading to a better and efficient legal system.
