Justice or Just Us? A Deep Dive into Capital Punishment in India
Abstract
The issue of capital punishment raises profound questions regarding justice, morality, and the efficacy of the legal system. In India, the death penalty is a legal punishment reserved for the “rarest of rare” cases, but its use continues to be a subject of controversy. This paper critically examines capital punishment in India, considering historical contexts, significant case laws, and ethical dilemmas. Key cases, such as Bilkis Bano and the 2023 murder in Kashmir illustrate the complexities involved, highlighting both the potential for judicial error and the severity of certain crimes. By analyzing these facets, this paper aims to provide a comprehensive understanding of the justifications for and against capital punishment, ultimately arguing for a balanced approach to justice that minimizes the risk of wrongful convictions.
