Abstract

A piece of law known as the Employees State Insurance Act, 1948 (ESI Act) offers social security benefits to workers in India's organised sector. The act provides for a range of benefits, including medical care, cash benefits in the case of illness, maternity benefits, and pensions. The act applies to all establishments employing 10 or more persons and requires employers to contribute a portion of the wages paid to their employees towards the ESI fund. The Employees' State Insurance Corporation is in charge of carrying out the act's requirements and disbursing benefits to qualified employees. Numerous significant court cases involving the ESI Act throughout the years have influenced how the law is applied and interpreted. These court cases have provided clarity on several key provisions of the act, including the coverage of the act, the definition of an "establishment," and the definition of an "employee." The court cases have also played an important role in ensuring that the act is applied in a fair and consistent manner to all employees in the organized sector.
