Abstract

In our society, a person can be a witness or a victim of the criminal offence. When any crime is committed in the the society then it comes to the knowledge of the investigating officer after that the process of investigation starts.  Code of Criminal Procedure, 1973, prescribes the how the process of investigation starts and where it comes to an end. But  this paper only focuses how Supreme Court and High Courts interprets this section by taking different types of cases and even its scope and power of the Magistrate have been both expanded and limited in different spheres.
