LEGAL FRAMEWORK FOR PROTECTION OF CHILDREN AGAINST SEXUAL OFFENCES IN INDIA: AN EVOLVING CRIMINAL LAW PERSPECTIVE

Abstract

Child protection rights are fundamental to ensuring the well-being and development of children and when it comes to safeguarding children's health and growth, preserving their rights is of the fundamental importance. In spite of the fact that there are important legislative frameworks and policies in India that are aimed at protecting the rights of children, there is still a continuous gap between the intentions of the rules and the effectiveness of their execution. This research paper investigates the obstacles that are preventing the effective enforcement of child protection rights in India and suggests measures that might be used to close the implementation gap that has been identified. The purpose of this research paper is to identify systemic hurdles and offer concrete ways to increase child protection systems in the context of India. This will be accomplished through the analysis of legal frameworks, case studies, and the viewpoints of affected stakeholders. For the purpose of providing a secure and supportive environment in which children can flourish, it is essential to ensure that their rights to protection are effectively enforced. It is possible for India to be able to keep its promise to defending the rights and dignity of its children if it addresses the implementation gap through comprehensive policy reforms, institutional strengthening, and community participation.
