RIGHTS OF REFUGEES AND THE INTERNATIONAL ORDER

Abstract

Owing to a well-founded fear of being persecuted of reason of race, religion, nationality, membership of a particular social group or political opinion, is outside the country of his nationality, and is unable to, or owing to such fear, is unwilling to avail himself of the protection of that country, such is the definition of “Refugee”. The research primarily focuses upon the international legal agreements which have been entered into by different countries of the world. After World War II, there was big unrest in the Middle East countries and billions of people were displaced from their homes. It was a clash of ideologies, a clash for not sharing resources with the western countries, a clash with the army personals, and a clash with the government of the country. The research while focusing upon the International legal agreements takes a slight turn towards the humanitarian approach and the steps which must be taken to curb such types of problems in the near future. Furthermore, the states must make awareness among their citizens that everyone has a right to be treated equally and every life matters. This problem was very much highlighted when a dead body of a baby named “Alan Kurdi” was found on the Turkish beach. It attracted the attention of the world and the issue faced condemnation by the international community and raised many questions upon the steps taken by the states which primarily entered upon the international legal agreements to curb the situation in hand. It has constantly been noted that the states which have entered into such treaties are not following it properly and also it has been observed that thousands of refugees are sent back either in the international oceans or the war-ridden areas of Syria, which results in the death of thousands of people, who die without any cause. Moreover, the research also focuses upon the cycle of hatred which has been kicked off by the start of this war and it is not just a prediction but also a reality that someday this problem will come to bite our faces and if we sit today silently speaking nothing then tomorrow we might even lose the right to even stop that problem from biting our faces. In this research, we must be addressing certain questions as to why the country like India, which follows the principle of “Vasudev kutumbakam” has not signed the treaty of the refugee convention.
