Surrogacy Law with Special Reference to Surrogacy (Regulations) Bill, 2019

Abstract

In this research paper, firstly, the researcher tries to define surrogacy, reasons for surrogacy, guidelines on surrogacy by the Law Commission, and key provisions of Surrogacy (Regulations) Bill, 2019, and discord and confutation related with surrogacy in India. The article also attempts to analyze whether the Surrogacy (Regulations) Bill, 2019 is efficient in safeguarding surrogacy through strict and transparent mechanism, by the commercial surrogacy.
Also,  exploitation of law by wrongful misuse of ‘close relative’ clause due to failure of the legislation to define the term ‘close relative’ clause.
