Abstract

Transactions involve payment of stamp duty in majority of the states. However, the position as to whether the payment of stamp duty will be on the basis of per instrument or per transaction is yet to established by the courts. In Costal Gujarat Power Judgement, the Hon’ble High Court of Gujarat held that the stamp duty is payable on per lender per transaction basis. The ruling is limited to State of Gujarat only and its applicability is yet to be seen in other states.
