Abstract

The Tom Kabinet ruling disappointed advocates of consumer welfare as well as those of digital single
market. Upon analyzing thoroughly the many drawbacks of the Tom Kabinet ruling, this paper
proposes both legal and technological changes which while protecting the copyright-holders, will
make possible resale of e-books.
