Cybersquatting in India: Analyzing Legal Challenges and Dispute Resolution Approaches

Abstract

Cybersquatting, in which people or organizations register domain names that are confusingly like or identical to already-existing trademarks with the intention of making money off them, has become a major problem in India’s digital landscape. In addition to undermining the rights of trademark holders, this approach confuses customers and could harm the reputation of respectable companies. The Trademarks Act of 1999 and the Information Technology Act of 2000 serve as the main pillars of India’s legal framework against cybersquatting. Although these rules offer some degree of protection against trademark infringement, their absence of provisions specifically designed to address cybersquatting makes enforcement difficult. The legal issues raised by cybersquatting in India are examined in this article, along with the many dispute resolution procedures that impacted trademark
owners can use. The usefulness of litigation, cease-and-desist letters, and alternative dispute resolution procedures in resolving these conflicts is covered in the article. In the end, the analysis emphasizes the necessity of comprehensive laws that particularly target cybersquatting to improve trademark owners’ protection and guarantee an equitable online economy in India.
