Presently, individuals are increasingly conscious of their environment, voicing support for positive causes and opposition against negative ones. Thus something which has existed for the past many decades and never objected on a larger scale are being pointed out and criticized as regards to its negative aspect. An example of this would be Hindustan Unilever’s face cream with the trademark ‘Fair and Lovely’. With the increasing awareness among people regarding racism, using words like fair, whitening etc… were considered derogatory. In this research paper we will see why Hindustan Unilever took the step of changing its trademark from ‘Fair and Lovely’ to ‘Glow and Lovely’, if such a trademark is applied for registration can it be rejected, what can be done to avoid registration of such derogatory trademark, legally.
