Exploring the Extent of the Law of Patent and Trade Secrets in India with Special Reference to Effects on the Corporate Sector

This research paper investigates the framework of patent law and trade secret protection in India, focusing on their influence on the corporate sector. It reviews the Indian Patent Act, 1970—amended to meet TRIPS obligations—and the lack of a codified law for trade secrets, exploring how these factors shape corporate innovation and competitiveness. The study utilizes case studies to assess the impact of intellectual property laws on corporate strategies and examines whether India's legal infrastructure effectively supports innovation while promoting fair competition. Furthermore, the paper addresses challenges faced by Indian corporations, such as patent infringement litigations and the high costs of patent registrations, discussing their implications for both multinational and domestic firms. Recommendations for legal reforms and enhanced judicial training are proposed to
strengthen this framework, enhancing corporate growth and innovation. This analysis aims to provide policymakers, legal practitioners, and business leaders with insights to optimize intellectual property regulations in India.
