Abstract

The protection and enforcement of copyright in Cameroon are not new concerns but they are given new impetus and importance when copyrighted works are infringed across borders notably on the internet. The duty of safeguarding and upholding copyright in Cameroon is now carried out through a multitude of institutional and legal systems. It is frequently questioned how digital copyrighted works are protected in Cameroon given the existence of these laws and institutions. This is the main concern to
which this essay seeks to provide an answer. To address this issue, more emphasis has been on the various methods of copyright infringement on the internet and how it can be remedy while taking into considerations the difficulties involve. This paper concludes on the strength that the protection and enforcement of Copyright on the internet under the Cameroonian copyright law is not really effective due to the loopholes created by the internet itself and copyright. We therefore suggest that, the Cameroonian law makers should clearly legislate on the liabilities of internet service providers or intermediaries that facilitate infringing activities on the internet.

The proof of subsistence is daunting in this context because the registration requirement is not a sine qua non for copyright to subsist in a piece of literary or scientific work. Mere expression is sufficient.

Derived from the Latinism, “actoriincumbitprobatio onus probandiestincumbit qui decit non qui negat”. It was used in Copyright Law in the case of Creative Technology Ltd. Aztech Systems Pty Ltd FSR 491, (1997).
