Interplay Between WTO Rulings and ISDS Outcomes: Shaping Security Clauses in International Investment Agreements
Abstract
The intricate web of agreements and regulations governing international trade fosters smooth commerce between nations. However, disputes are bound to occur. When unfair trade practices are identified or investments are at risk, two separate mechanisms are available for resolving disputes: the World Trade Organization (WTO) and Investor-State Dispute Settlement (ISDS). While they both seek to tackle issues in the field of global trade, their methods differ greatly.
