Abstract

The importance of the treaties of 1921 and 1940, which were concluded before the collapse of the Soviet Union, is due to the importance of the Caspian sea. These treaties are considered to outline the legal regime of the Caspian Sea, and due to the importance of political-economic security, geography, etc., it becomes a regional and even trans-regional concern, since the only solution to determine the legal regime of the seas is in the borders International is the conclusion of a treaty. The Iran-Soviet treaties of 1921 and 1940 become important because these two treaties are among the treaties that remained in force among dozens of treaties concluded with the Caspian issue, and even after the collapse of the Soviet Union, the implementation of the obligations of the commonwealth of Independent States They guaranteed the contracts of the Soviet Union, but the practical procedure and arguments of these countries over the years have shown the opposite of this, to the point where only a name remains of the said treaties today, and today independent countries consider these treaties invalid. Although these countries are not bound by the obligations of these treaties according to the clean slate doctrine, the 1921 and 1940 treaties are objective treaties with a border issue, which are essentially separated from the body of the treaty and become the rule of the organ omens or against all. These disputes continued until today. Despite its fundamental importance, the Caspian Sea has no internationally recognized border. This article was prepared in order to examine the differences between the current practice of countries and the legal system governing the aforementioned treaties using the criteria provided in international law.
