Negligence and Tortious Liability: Compensatory Aspects and Legal Provisions

tort is a legal term for civil wrongdoing occurring when someone infringes upon another person's legal rights without breaching a contract. This person or thing is referred to as the tortfeasor. The tortfeasor may be held liable for this infringement under tort law. Tort liability may take many different forms, including carelessness. An explanation of tort law's workings, circumstances in which a
tortfeasor may be held accountable, and victim legal remedies are all covered in this tutorial. In circumstances of negligence, the parties' relationship is not contractual. This might occur between strangers, like two drivers in an accident, or between known parties, like a surgeon and a patient. Determining whether a connection exists at all is the first problem in negligence claims as there isn't a
pre-existing agreement. It is necessary to demonstrate a duty of care before one person may be held negligently responsible for another. This paper explores the dimensions of negligence and tortious liability for compensatory aspects and legal provisions.
