Reconceptualizing Spousal Support in Modern Dual-Earner Marriages

Abstract

The institution of spousal support, traditionally grounded in the economic dependency of one spouse typically women has undergone significant scrutiny in the context of modern dual- earner marriages. Increasing female workforce participation, evolving family structures, and the rise of flexible and gig-based employment have transformed marital dynamics and
financial interdependence. This paper critically examines the adequacy of existing legal frameworks governing spousal support in addressing contemporary realities. It argues that traditional models of alimony, based on dependency and fault-based considerations, fail to reflect the economic complexities of dual-income households. Through a doctrinal and socio-
legal analysis, this study explores changing gender roles, career sacrifices, unpaid care work, and economic inequality post-divorce. The paper proposes a reconceptualized approach to spousal support grounded in partnership theory, compensatory justice, and gender equity. It further recommends policy reforms including standardized guidelines, recognition of non- monetary contributions, and time-bound rehabilitative support.
