Child Custody During the Separation of Parents

Abstract

The meaning of the custody of the child during separation of parent is whenever husband and wife take a decision to separate from each other. Then it takes so much time to decide that particular disputes between spouses. At the time of the separation proceeding it becomes difficult for child to deal with that particular environment. even though it is a right of child to get love and affection from their parents. However, the custody of children below the age of five years old is given to the mother. If the child is above than 9-year-old age, then it is depending upon the court to decide the guardian in the welfare of the child. But at time of the divorce proceeding it’s become difficult to child to manage about all these problems because it is a right of the child to get all basic need as well as the love and affection from their parents. At the time of the proceeding child is also suffer then it became important to take care of child and give the custody of the child to grandparents so that they can provide a healthy environment for child and child should not treat as a “chattel”.
