Abstract

As we know, marriage and divorce are two interrelated phenomena that coexist. Marriage is a union formed through the bond of matrimony, and in cases of irreconcilable differences, lack of belief, or internal disputes, divorce becomes applicable to the husband. It is evident that two individuals are never identical in terms of appearance, color, or nature, as they inherently possess distinct characteristics. While Islam aligns with human desires at all times and places, and is never in favor of separation between husband and wife, divorce is permitted due to the recognition of human rights and the support for their desires. The Prophet Muhammad (peace be upon him) explicitly stated, “Hate What is permissible according to God is divorce” The most detestable of permissible things to Allah is divorce. There is no doubt that marriage and divorce are two distinct and contrasting phenomena.
Marriage establishes the foundation for two individuals’ lives and fosters good communication between them, creating a marital relationship. On the other hand, divorce serves as a means of separation and dissolution between a husband and wife. Divorce has been a solution to end marital life even before Islam in various divine religions. However, Islam acknowledges this practice, disapproves of it, and considers it the most undesirable lawful action. In conclusion, when peace is unattainable and conflicts persist between the parties involved in family disputes, divorce becomes the ultimate solution for marital relationships in Islam.
