Abstract

The rights of LGBTQ individuals in India have evolved over the years. However, LGBTQ citizens still face a number of social and legal challenges in comparison to non-LGBTQ individuals. It is the court’s responsibility to issue a fair and reasonable order, the government's responsibility to ensure that the verdict reaches the general public, and the public’s responsibility to enthusiastically accept the court's decision. However, despite the fact that the Supreme Court of India in the Navtej Singh Johar vs. Union of India judgment of 2018 stepped up and abolished a portion of Section 377 of the Indian Penal Code that criminalized acts of homosexuality, the situation regarding the LGBTQ+ community has not significantly improved even after nearly 30 months have passed since the landmark judgment was passed. The LGBTQ community failed to gain societal acceptance from the nation's citizens, and neither the federal nor state governments made any special provisions for their advancement.
