Victim-Centered Approaches in Rape Law: Bridging Global Human Rights Frameworks and Indian Legal Practices

Abstract

The effective strategy for dealing with survivors of sexual assault in the judicial system is victim-centered rape laws.  Even if they are not the criminal victim and are only collaborating to be punished, it prioritizes their safety and future rehabilitation.   Those who punish others should not be seen as prophets, and those who violate the law and cause harm to others should not be viewed as wicked.  In addition to punishment, it's critical that those who violate the law allow their survivors to start again.  Advocates for human rights across the world say this. In essence, their human rights will be violated.   Given that collective guilt eventually results in rewards and that the lifestyles of criminals tend to get more sophisticated, is it possible that there is yet a deeper category of criminal victim that has not yet been discovered?  In addition to hoping for safety, survivors should have a team of attorneys working in their best interests if India's anti-rape laws have become more stringent and the police have fewer survivors. India's rape laws have become more stringent due to a recent statute.   However, the best victim-centered policies and processes must be completely implemented.
