Parental Disownment: Implications for Property Transfers Among Children in India

This paper investigates the phenomenon of children disowning their parents following property acquisition in India, utilizing a qualitative research methodology that includes case law analysis, interviews with legal practitioners, and a review of media reports. The study seeks to answer the following research questions: How do existing legal frameworks address property transfers from parents to children? What are the emotional and financial impacts on disowned parents? Key findings reveal a significant gap in legal protections for parents, with many cases highlighting emotional distress and financial insecurity. The analysis emphasizes the need for reforms in property law and judicial practices to safeguard parental rights. This paper ultimately advocates for a comprehensive legal framework that addresses both property rights and familial responsibilities.
