Abstract

Honour killing is one of the most extreme manifestations of gender-based violence, rooted in patriarchal notions of family honour, social prestige, and community control over women's autonomy. The practice involves the murder of women by family members or relatives who perceive their conduct, choices, or relationships as bringing dishonour to the family. Despite constitutional guarantees of equality, dignity, and personal liberty, honour killings continue to occur in various parts of India, reflecting deep-seated socio-cultural norms and discriminatory attitudes toward women. This study undertakes a socio-legal analysis of honour killings, examining the social, cultural, and legal factors that contribute to the persistence of this practice. It evaluates the role of caste, religion, customary practices, and patriarchal structures in perpetuating violence against women in the name of honour. The research further analyses the existing legal framework, including constitutional provisions, criminal laws, and significant judicial pronouncements addressing honour-based crimes. The study identifies gaps in legal enforcement and societal responses, highlighting the challenges faced by victims and vulnerable individuals. Through a critical examination of legislative measures, judicial interventions, and policy initiatives, the article advocates for stronger legal mechanisms, effective implementation of laws, and comprehensive social reforms aimed at protecting women's rights and eliminating honour-based violence. The study concludes that a combination of legal deterrence, awareness generation, and societal transformation is essential to eradicate honour killings and uphold the principles of justice, equality, and human dignity.
