Abstract

It goes without saying that India tends to have maintain quite a protectionist stance when it comes to intellectual property laws, especially in terms of patents. One such thing is the exclusion of certain industries namely inventions related to agriculture, medication, nuclear technologies, and software as stated in the Patents Act of 1970. This paper goes through the exact wording of the Patents Act of 1970 along with the 2014 approval of a patent by the Indian Patent Office for a vaccine produced by Pfizer Inc. to identify loopholes and legal technicalities present in the legal precedence followed by India that can allow such things to occur.
