Abstract

There are several Human Rights issues involved in surrogacy. The Universal
Declaration of Human Rights 1948 provides the individuals of full age shall have
right to marry and found a family. It would be difficult for an infertile couple to
construct a family. Surrogacy could be an alternative. But surrogacy encompasses
delicate social, ethical and legal issues. Safety, security and health of the surrogate
mother and the child could be at stake. The responsibilities of the Surrogacy Clinics,
the rights and duties of the commissioning parents and the genetic parents etc., shall
be exhaustively interpreted. The Law shall be comprehensive enough to deal with
such issues.
